Prior to this alleged offence, our client was issued a final Apprehended Domestic Violence Order (AVO) in favour of the complainant.
On the night of the alleged offences, our client returned entered his home and saw the complainant; his wife dancing. Our client allegedly grabbed her arm and attempted to kiss her to which she did not reciprocate. Our client fell asleep on the living room couch and the complainant slept in their bed. Our client allegedly woke up and walked into the bedroom and lay next to her. It was alleged that the complainant attempted to push our client out of the bed as he was attempting to kiss her and touch her body. It was alleged that the complainant tried to leave the bed, however, our client grabbed her by the wrist forcefully causing markings.
Soon after, police were called and arrived on the scene. Our client was observed to have a strong odour of alcohol coming from him. Our client was arrested and conveyed to Fairfield Police Station.
Our client was arrested and charged with the following:
- Assault occasioning actual bodily harm (domestic violence related) contrary to Section 59(1) of the Crimes Act 1900.
The Maximum penalty for this offence is 5 years imprisonment. - Sexually touch another person without consent contrary to Section 61KC(a) of the Crimes Act 1900.
The Maximum penalty for this offence is 5 years imprisonment. - Contravene prohibition or restriction in an Apprehended Domestic Violence Order (AVO) contrary to Section 14(1) of the Crimes (domestic and personal violence) Act 2007.
The Maximum penalty for this offence is 2 years imprisonment and a fine of $2200.

The matter proceeded to a Defended Hearing where Mr Taleb appeared at Fairfield Local Court. Mr Taleb Defended the charges and ultimately the charges were dismissed!
